Uniden Australia is pleased to inform our customers that there are new Australian Consumer Laws (“ACL”) regarding warranties against defects, effective from 1st January 2012. If you qualify as a “Consumer” – under the ACL, we must give the following mandatory notice:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These laws assist to provide clear and concise communication from suppliers to consumers of their rights. Uniden Australia fully supports these laws.
Uniden Australia’s Warranty Terms are fully documented in the Owner’s Manual provided with each product. Additionally these Terms are restated on our web site and can be viewed in the ‘CUSTOMER SUPPORT / Warranty Information’ section on our web site.
Uniden Australia has already taken the following steps to update our warranty documentation to include these new laws:
- We have updated our Terms at the back of the Owner’s Manuals for over 100 products across Australia and New Zealand.
- For products manufactured from November 2011, if new Owner’s Manuals have not been able to be printed in time for the course of production, we have inserted an Addendum sheet into all production stock. This sheet identifies all the new warranty terms for consumers. A copy of this Addendum sheet with the complete statement of Uniden’s Warranty Terms is included below.
- We have updated the electronic versions of our product Owner’s Manuals that contain the updated warranty Terms on our web site since November 2011.
However we still have considerable volumes of stock (“stock on hand”) either in our Sydney warehouse or in the supply chain with our retail partners. This product packaging cannot be opened or tampered with to insert updated Terms without negatively affecting the stock. Therefore due to these serious practical transitional difficulties in updating local warranty documents to comply with the new ACL provisions, particularly with Regulation 90, this stock may contain warranty documents that are not fully up to date with the new consumer laws. We expect this “stock on hand” to sell through the supply chain in the near future. However, consumers can be fully assured that all of their rights required by the new laws will still be 100% supported by Uniden Australia.
Uniden Australia believes that in view of these practical transitional difficulties and given the measures outlined above, we have taken all reasonable steps to convey the mandatory text and information required by the ACL to our end users.
